What is industrial hemp
Idustrial hemp (hemp) is a variant of cannabis sativa with low concentration of THC, according to the regulation less than 0.2% THC..
Although cannabis as a drug, and industrial hemp both derive from the Cannabis sativa species and contain the psychoactive component tetrahydrocannabinol (THC), they are distinct strains with unique phytochemical compositions and uses. Hemp has lower concentrations of THC and may have higher concentrations of cannabidiol (CBD), which decreases or eliminates its psychoactive effects. The legality of industrial hemp varies widely between countries. Some governments regulate the concentration of THC and permit only hemp that is bred with an especially low THC content.
International conventions establish the legality of cannabis uses as long as they are industrial or horticultural uses. The regulation of industrial hemp varies relatively between countries, some governments regulate the concentration of THC and only allow hemp with a particularly low content of this component. Currently in Spain this concentration is determined at 0.2%. From this percentage we are dealing with narcotic cannabis or industrial hemp.
Hemp is a fast growing and very versatile plant in the sense that it is grown for different industrial and commercial uses. It is used to manufacture various products, including, fabrics, clothing, ropes, shoes, food, paper, bioplastics, insulation, biofuel as well as various phytochemicals other than THC that are used in various fields, for example to make oils, cosmetics, food products for humans and animals etc. in particular and currently highlights the cannabidiol component CBD, although research on the plant is providing new and interesting data in relation to other components, such as CBG, among others.
Regulation
Since the 1970s, hemp cultivation has been perfectly regulated within the EU’s common agricultural policy, initially through EEC Regulation 1038/70, which was subsequently amended by EEC Regulation 1430/82, and in which established percentages of 0.5% and 0.3% THC until EEC Regulation 1672/2000 which decreased the concentration for hemp to the current percentage of 0.2% THC. The European Parliament has recently approved the re-application of 0.3% for a subsequent amendment to the regulations governing industrial hemp.
According to European regulations, a hemp plantation for fiber and seeds is totally legal as long as varieties with a component of less than 0.2% THC are used. In addition, and in the sense of complying with the requirement to be able to access European aid within the framework of the common agricultural policy, the varieties must be certified-certified seed, this means that they are those listed in the common catalogue of varieties of agricultural plant species. Common Catalogue of Varieties of Agricultural Plant Species. (2019 / C 13/01).
CBD (cannabidiol)
This cannabinoid is characterized by having many of the therapeutic properties of cannabis, but without causing psychoactivity and is therefore in demand by pharmaceutical companies, food, cosmetics and so on
Despite the confusion that has existed in recent years in relation to CBD, the Court of Justice of the European Union has recently ruled in the KanaVape case that the CBD component can be marketed within the EU as long as it is legally produced in a Member State.
Currently, for the transformation or extraction of CBD in Spain, the permission of the Spanish Agency for Medicines and Health Products (AEMPS) is required.
